Gurumurthy Kalyanaram – Reports on Expert Witness Testimony in a False Claims Act/ qui tam Lawsuit

Gurumurthy Kalyanaram - Former Dean and former NYIT and UT Dallas professor Gurumurthy Kalyanaram reports on his expert witness testimony in a False Claims Act/qui tam lawsuit based upon my expert witness testimony, the US government decided to intervene in a qui tam lawsuit against two private educational entities.

The background to the lawsuit is as follows. Two educational entities had collaborated and designed an on-line educational program. According to the complaint, the institutes were purportedly offering degrees without completion of the requisite requirements, employing unqualified faculty and using inadequate facilities. The on-line educational program was also purportedly engaged in commissions-based student recruitment process.

In a somewhat historic but also development, the U.S. House of Representatives voted on June 30, 2014 to authorize Speaker John Boehner to file a lawsuit against President Obama for his abuse of authority. The vote was completely partisan – all the Republicans except five of them voting to authorize such a lawsuit and all the democrats voting against such a plan. On Religious Freedom, Town of Greece v. Galloway Gurumurthy Kalyanaram NYIT


Galloway and several other residents filed a lawsuit complaining that his freedom of religious expression was violated by his town, Greece in New York, because the town board regularly began its meetings with a Christian-faith based prayer. The Court ruled in favor of the town holding that town boards may start their meetings with sectarian prayers, and do not have to make undue efforts to represent all the faiths. The Court held that the First Amendment was not violated.   This Court’s ruling is similar to the 1983 holding that Nebraska Legislature’s practice of starting its sessions with a prayer, saying the practice was “deeply embedded in the history and tradition of this country.” Gurumurthy Kalyanaram UT Dallas

Gurumurthy Kalyanaram - Reports on Criminal Justice System in India and US

Gurumurthy Kalyanaram, Former Dean & Former NYIT and UT Dallas professor - With regard to civil disputes, individuals file lawsuits against each other and the courts adjudicate the dispute.  The procedure is the same all over the world, except that in US the dispute is resolved by a jury of peers and in India it is done by a judge. With regard to criminal complaints, individuals cannot files lawsuits.  The jurisdiction lies with the State.  Individuals can file a complaint or a report, and the State will decide whether to file a criminal complaint/lawsuit or not against an individual or a group or an organization.That’s so, be it US or India.
